With the recent International Criminal Court’s development in the case of Joseph Kony and in light of domestic proceedings in Ukraine, discussions surrounding in absentia proceedings in ICL have resurfaced. The Nuremberg Academy has undertaken a research project on this contentious issue, aiming to determine the current situation within the framework of international human rights standards.
As the first instance of in absentia proceedings at the international level took place at the Nuremberg Trial, it is important to reflect on the proceedings in the case of Martin Bormann with the current perspective on in absentia proceedings. This historical analysis of this project will serve as the foundation for the comprehensive comparative analysis, drawing upon diverse cases at international and regional level. Other key elements, such as the political and financial considerations on in absentia proceedings, will also be taken into account. The overarching objective of this project is to advocate for due process and to uphold international law standards.
